any natural person who is acting for purposes which are outside his or her professional activity, wishing to make a purchase on the GARNIER-THIEBAUT website http://www.garnier-thiebaut.fr
hereinafter referred to as "THE CUSTOMER"
PURPOSE
The purpose of these terms and conditions is to define the terms of sale between GARNIER-THIEBAUT and THE CUSTOMER, from the placing of the order to the after-sales services, including payment and delivery.
These conditions exclusively concern natural non-trading individuals.
The items offered for sale on this site are sold exclusively to the CUSTOMER acting for his personal needs. They can only be acquired by a natural person of legal age.
THE CUSTOMER agrees not to resell the purchased items. GARNIER-THIEBAUT reserves the right to refuse to sell its products to any person whose behaviour may suggest that he/she might engage in such acts.
These general sales conditions govern the contractual relations between GARNIER-THIEBAUT and THE CUSTOMER, both parties accepting them without reservation. These general terms and conditions, fully accepted by THE CUSTOMER and applicable to any order placed on the site, shall prevail over all other terms and conditions of sale.
GARNIER-THIEBAUT reserves the right to modify the general terms & conditions at any time. They will then be applicable as soon as they are published online.
PRODUCTS
www.garnier-thiebaut.fr is a site that offers household linen, decorative accessories and textile items for sale.
The product offers presented by GARNIER-THIEBAUT online are proposed within the limits of available stocks.
GARNIER-THIEBAUT cannot guarantee that the products will remain available for sale during a given period.
Any claim by the CUSTOMER regarding the ordering or delivery of an unavailable item will be considered unfounded.
The essential characteristics of the products offered for sale are described and presented as accurately as possible.
The photographs of the products supporting the text are not contractual.
The colour visible on the CUSTOMER's screen is dependent on his/her computer system, so GARNIER-THIEBAUT cannot guarantee the exact colour that will be displayed.

PRODUCT DIMENSIONS:
Dimensional tolerance (inherent to the jacquard weaving technique): + or - 3%. Cotton is a natural fibre that may shrink slightly after the first wash (up to approx. 5%, the shrinkage varies according to the type of product used and the washing conditions).
TERRITORIAL SCOPE
The geographical area of coverage of the offer and delivery is the European Union, with the exception of France, Belgium, Germany and Austria.
PRICE
The prices of the products indicated on the site are in euros, including all taxes.
The VAT included is the French VAT at the rate in force for the products concerned.
The prices of the products do not include shipping and delivery costs (postage, packaging, preparation of the package, according to current rates).
The price of the delivery costs will be specified before the order is validated.
If one or more taxes or contributions have just been created or modified, whether they represent an increase or decrease, this change could be reflected in the selling price of the products present on the Internet site and on the various sales media.
However, the price cannot be changed once the order is validated.
ORDERING AND AVAILABILITY
THE CUSTOMER places his/her order online from the catalogue displayed on the site www.garnier-thiebaut.fr.
The order can only be registered on the site if THE CUSTOMER has clearly identified him/herself beforehand by entering his/her login details (e-mail address and password, which are strictly personal to him/her, and which he/she entered when registering on the site, under the heading “my account”).
Any order implies acceptance of the prices and description of the products available for sale.
The user has the possibility of modifying his/her basket before the final validation, this last step formalises the sales contract between GARNIER-THIEBAUT and THE CUSTOMER.
Orders only become final after GARNIER-THIEBAUT has expressly accepted the order, which will be confirmed by the sending of an acknowledgement containing the constituent elements of the order to the CUSTOMER's e-mail address.
GARNIER-THIEBAUT will only deliver the ordered products once the CUSTOMER's bank has confirmed the payment.
In the event of a refusal from the bank, the order will be automatically cancelled and the customer notified. GARNIER-THIEBAUT reserves the right to refuse any order from a customer with whom there is an ongoing dispute.
GARNIER-THIEBAUT undertakes to honour the orders received on the website only within the limits of product availability.
If the product is not available, GARNIER-THIEBAUT undertakes to inform the user.
In the event of unavailability of an ordered product, GARNIER-THIEBAUT will inform THE CUSTOMER by e-mail or by phone as soon as possible. THE CUSTOMER will then have the choice of cancelling the order or exchanging the product(s) concerned.
PAYMENT

All purchases must be paid in full before delivery.

The payment of the orders is carried out online on the site, by bank card (Carte Bleue, Visa, Eurocard, Mastercard) using a secure electronic payment terminal, provided by CM-CIC P@IEMENT, which uses the SSL protocol (Secure Socket Layer) so that the transmitted information is encrypted by a piece of software and that no third party can intercept it during its circulation on the Internet network.
For payments by credit card, the order will only be validated by GARNIER-THIEBAUT once the bank server has authorised the transaction. This payment requires you to registered your mobile / landline phone number with your bank beforehand in order to ensure that the banking information can be properly entered in the credit card payment security fields proposed by Garnier-Thiebaut.
By choosing payment via PayPal, the CUSTOMER will be automatically directed to his/her PayPal account. Once the PayPal payment is validated, the order can be completed on the site.
Payment by cheque is permitted. Once the cheque has been cashed, delivery will be carried out, approximately two weeks after receipt of the cheque.

DELIVERY
GARNIER-THIEBAUT's automatic data storage systems are considered as proof of the nature of the sale and its date.
GARNIER-THIEBAUT commits, after confirmation of the order and validation of the payment in accordance with the Price and Payment articles in this document, to sell and deliver the ordered products to the designated recipient within 96 hours in the European Union (except for France, Belgium, Germany and Austria) if the order is placed before 12 noon.
Any order placed after 12 noon on Thursdays will be shipped by GARNIER-THIEBAUT on the following Monday.
The above deadlines do not include postal delivery problems and are subject to product availability, and do not include custom-made products , periods when the textile mill is closed and public holidays. Custom products are manufactured and shipped within 7 business days.
GARNIER-THIEBAUT reserves the right not to carry through an order in the event of a force majeure and undertakes to inform THE CUSTOMER.
GARNIER-THIEBAUT is responsible for the choice of the transport and delivery method. The delivery will be made to the address indicated by THE CUSTOMER who undertakes to provide GARNIER-THIEBAUT with an address where the delivery can be made during working hours (from Monday to Friday).
In event of absence, a notice will be left so that a second delivery attempt can be organised with the carrier.
If the delivery time exceeds thirty days from the order, the sales contract may be terminated and the buyer reimbursed in full.
The costs of processing the order, shipping and postage are fixed at €5 (including taxes) for deliveries to relay points, they are fixed at €8.50 for home deliveries of products costing more than €50 (including taxes) and €5 for home deliveries of products costing less than €50 (including taxes), excluding any promotional period or possible discount, and excluding alternative face masks.
For alternative face masks, shipping costs vary according to the total weight of the order, the following scale for weights is applied:
1. 0.25kg: €8.50 including taxes
2. 0.50kg: €9.50 including taxes
3. 0.75kg: €10.50 including taxes
4. 1.00kg: €11.50 including taxes
5. 2.00kg: €12.50 including taxes
6. 3.00kg: €13.50 including taxes
7. 4.00kg: €14.50 including taxes
8. 5.00kg and above: €15.50 including taxes

RECEPTION
By placing an order, THE CUSTOMER agrees to take delivery of the products he/she has ordered and to pay the price and shipping costs.
GARNIER-THIEBAUT guarantees that the products are subject to the necessary care in order to ensure their conformity to their description on the website.
The customer's attention is however drawn to the fact that he/she is solely responsible for the conservation and use of the products from the time they are delivered.
In the latter case, THE CUSTOMER guarantees the personal acceptance of these general conditions by the recipient of the package.
THE CUSTOMER is responsible for any damages that GARNIER-THIEBAUT could suffer, directly or indirectly, due to non-compliance by him/her or by the person who takes delivery of the products with his/her obligations as laid out in these general sales conditions.
WITHDRAWAL PERIOD, RETURN POLICY, REFUNDS, EXCHANGES
In accordance with Article L.221-18 of the French Consumer Code, the CUSTOMER has a period of fourteen days to exercise his/her right to withdraw from a contract concluded at a distance.
To exercise this right to withdraw, the CUSTOMER can complete the standard withdrawal form to be found here.
During this period, the CUSTOMER may return the products without having to justify his reasons or pay any penalties.
All products can be returned, except those excluded by law, for example products that have been customised at the request of the CLIENT. Garnier-Thiebaut will not accept returns for custom-made tablecloths and for any order of fabric by the metre, as well as for alternative anti-emission face masks.
Returned products must be intact and complete and must not have been used.
Except in the case of a defect or fault affecting the product, the cost of returning the product will be borne by the CUSTOMER.

If the CUSTOMER wishes to proceed with an exchange, and if the replacement item is available, GARNIER-THIEBAUT will send it to the CUSTOMER after return of the replaced item and payment of the shipping costs.
The shipping costs of the replacement item are also at the CUSTOMER's expense.
The refund is made by credit card according to the payment method used by the CUSTOMER when ordering online.

COMPLAINTS
The products delivered by GARNIER-THIEBAUT are subject to the most rigorous care before their packaging and shipment, which is carried out in such a way as to ensure that the product is protected.
In the event of a visibly damaged package upon receipt, THE CUSTOMER must ensure that the problem is noted upon delivery and immediately recorded on the driver's delivery slip or on the form reserved for this purpose.
If the damage is inside the package, THE CUSTOMER must urgently communicate in writing without prejudice to the carrier, and this at the latest within 96 hours. This communication must be specific and detailed. A copy of this document must be sent simultaneously to GARNIER-THIEBAUT by postal or electronic mail together with the transport document.
In case of missing goods in the parcel, the customer must notify GARNIER-THIEBAUT within 96 hours after receiving the parcel.
After verification and investigation by its services, GARNIER-THIEBAUT guarantees, if necessary, that the missing goods will be sent and the shipping costs covered.
GARNIER-THIEBAUT strongly urges THE CUSTOMER to check the parcels upon receipt, in the presence of the carrier if possible.

GUARANTEES
All products on sale on the site benefit from the legal guarantee of conformity and the guarantee against hidden defects.
GARNIER-THIEBAUT will guarantee that the products delivered comply with the legislation in force and that they have been subject to the most attentive care before being packaged and shipped in such a way as to ensure that they are in the best condition.
In the event of any deterioration in the quality of the products, THE CUSTOMER must return the products for examination to the address indicated above, after having previously obtained a return number, by postal or electronic mail, signed by GARNIER-THIEBAUT. Any request for a return should be made via our contact form, click here to access it, or by phone on +33 (0)3 54 72 94 00 (standard rate call) from Monday to Friday from 8:30am to 12:30pm and 1:30pm to 5:30pm.
In the event of THE CUSTOMER returning products for any reason whatsoever without a return notice signed by GARNIER-THIEBAUT, the latter may refuse to accept the products.
The reception of the products by GARNIER-THIEBAUT will not be considered as recognition of its responsibility.
In the event of the existence of the defect being recognised by GARNIER-THIEBAUT, THE CUSTOMER will be able to either exchange the product or to obtain a refund for the faulty one.
In the event of exchanging the product due to a defect, GARNIER-THIEBAUT will be responsible for the shipping costs.
PROOF
Providing the credit card number online and validating the order will be considered as proof that the order is complete, in accordance with the provisions of Article 1316 of the Civil Code.
This validation is equal to a signature and to the express acceptance of all the operations carried out on the website.
The archiving of purchase orders and invoices is made on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with the provisions of Article 1348 of the Civil Code.
INTELLECTUAL PROPERTY RIGHTS
All the elements of the GARNIER-THIEBAUT website are and remain the exclusive intellectual property of GARNIER-THIEBAUT, including the GARNIER-THIEBAUT logo, brand and photos.
Downloading, reproducing, use, or republishing elements of the site whether software, visual or audio, for any purpose whatsoever, even partially, is prohibited. Any simple or hypertext link is strictly forbidden without the express written consent of GARNIER-THIEBAUT.
The use, for sale or any other commercial use, of this website or its content (listed products, descriptions, prices, downloading or copying of information, use of data, images, texts, photographs, tools, sound extracts) is prohibited without an express written agreement from GARNIER-THIEBAUT.
All the elements of the GARNIER-THIEBAUT website are protected by copyright, trademarks or patents. They are the exclusive property of GARNIER-THIEBAUT.
PERSONAL DATA
Personal information collected for the purposes of distance selling is compulsory, as this information is essential for the processing and delivery of orders and the preparation of invoices.
Failure to provide this information will result in the order being invalidated.
The customer gives his/her consent for the use of the personal data collected under the terms of this order for the customer files of GARNIER-THIEBAUT.
In accordance with the law n° 78 -17 of January 6, 1978, the processing of this personal information is subject to an ongoing declaration to the French National Commission of Data processing and Freedoms (CNIL). The declaration reference number is: 1421513.
At any time, the CUSTOMER has a right to access and rectify his/her personal information, that he/she can exercise by contacting GARNIER-THIEBAUT.

DISPUTE RESOLUTION AND APPLICABLE LAW
These general terms and conditions are subject to French law.
Any dispute as to the validity, interpretation or execution of the present contract will be submitted to the jurisdiction of the courts of GARNIER-THIEBAUT's domicile.
GARNIER-THIEBAUT is at the CUSTOMER's disposal to resolve any dispute that may arise and to find an amicable solution.

The website complies with French legislation and more particularly with the regulations pertaining to distance selling.
